how come some folks, 'badger', can declare draws? why isn't it automatic as per the professional rules?

Thema: The draw debate

haven't had much of a problem with 'irksome' folks not conceed draws here. But how come the game doesn't automatically declare a draw when the same board position is repeated three times? that's how it works on its your turn, and that seems a very reasonable system.
